New regulations for short-term rentals in Vienna

New regulations for short-term rentals of apartments have been in effect in Vienna since July 1, 2024. Commercial short-term rentals are limited to a maximum of 90 days per year. If you wish to rent beyond this period, an exemption permit is required, valid for a maximum of five years. The consent of all co-owners is essential. Furthermore, the apartments must not be located in residential zones. Residential zones can be requested from us at any time.

The difference between living space and usable space

A common concern among our customers is the clarification of the terms “living space” and “usable space.” According to the Austrian Condominium Act, living space includes the usable living space of an apartment, i.e., all habitable rooms such as bedrooms, living rooms, and bathrooms. Balconies and terraces count as 25% of the usable living space, while heated conservatories count as 50%.

Usable space, on the other hand, refers to the total floor area minus wall thicknesses and openings. It should be noted that the area under sloping roofs is also included in the usable space, while stairs, balconies, and ancillary objects such as basement compartments are not included.
